These bills are presented as addressing “hate,” but in reality, they rely on broad, vague, definitions of harm and intent. They allow anonymous reports and investigations based on claims of feeling “unsafe,” even when no actual crime has occurred.
In today's culture, where disagreement is often treated as “violence,” this creates a system that is easy to abuse. Under HB 1903, students, parents, and citizens could be investigated simply for expressing sincerely held beliefs and convictions that are unpopular with others.
HB 1902 and HB 1905 also expand penalties and civil liability to allow normal, routine public disputes to turn into felony-level accusations if “intent” is interpreted through an ideological lens. HB 1904 requires judges to weigh “community impact standards” when issuing sentences, dangerous because they are often subjective and based on harmful ideology.
Even if someone is ultimately cleared, the investigation itself quickly becomes the punishment. This creates a dangerous and chilling effect on free speech.
Pennsylvania should protect both safety and liberty, not make subjective, ideological enforcement easier.
