Urge your House Representative to Reject Federal Pre-emption of State Legislation on Child Online Safety! 

The House is currently considering 11 bills that include federal pre-emption language for state legislation on child online safety. What this means is that states would not be allowed to pass new child online safety laws, and even laws that have already been passed could be rendered null. 

Considering that Congress has not passed a single federal law for child online safety law in 20 years, and any headway on this issue has been at the state level, this is simply terrifying.  

Contact your representative now, urging them to reject any bills with federal pre-emption language!

Dear Representative _______,  
 
I am one of your constituents writing to express my concern about the federal pre-emption language included in several of the child online safety bills currently before the House. This pre-emption language would do the opposite of what the bills set out to do—it would make the online world even more dangerous for children than it already is.  

Over the past few decades, states have worked hard to protect children online, and many have passed robust legislation. Under federal pre-emption, all the progress we have achieved in this area will go away. 

I understand that there are concerns about preventing a “patchwork” of different state legislation that would be difficult for the tech industry to comply with. However, I believe this concern is misguided. 

Most other industries in America is required to comply with differing state legislation. Why should this be so difficult for Big Tech, a multi-trillion dollar industry that is arguably the most powerful and influential entity on the planet.

Big Tech already enjoys shocking privileges that no other industry enjoys—specifically, sweeping immunity from liability under Section 230. Federal pre-emption would only enable them to act with further impunity.  

It is time to stop giving the tech industry special privileges that allow them to wreak havoc on our children. I urge you to firmly and unequivocally reject any federal pre-emption language for child online safety!
