Take it Down Act PASSED the Senate! Keep the Momentum Going in the House: 
Tell Your Representatives to Pass the #TakeitDown Act!

The Take it Down Act (S. 146) has passed the Senate! After tireless advocacy by survivors of Image Based Sexual Abuse, the Take it Down Act will finally make Image Based Sexual Abuse a federal crime! This groundbreaking legislation will require platforms to detect and delete any images reported by the victim, finally requiring action from Big Tech.

Now, we must keep the momentum going in the House.The Take It Down Act has been backed by over 100 organizations. The Take it Down Act (H.R. 633) as 9 bipartisan cosponsors in the House, and we need more. We also need support from House leadership! 

Representative Brett Guthrie, Chair of the House Energy & Commerce Committee, and your Representatives need to hear that survivors of Image Based Sexual Abuse can’t wait. Please tell them to cosponsor the Take it Down Act by calling their office, and taking action below.

When the Internet was created, it was surrounded by optimism for the future of communication. Yet it quickly became a hotbed for dangerous and obscene content – prompting action through the courts and legislative bodies.  

The Communications Decency Act (CDA) was passed by Congress in 1996 with intentions to combat content harmful to minors on interactive technology platforms, while also protecting budding internet companies from what was posted by third-party users. While most of the CDA was struck down by the U.S. Supreme Court, the CDA’s section 230 was allowed to remain. This section provided a shield to tech companies so that they would not be considered liable for what third-party users might upload to their platforms. In the years since, this remaining section of CDA, only 26 words long, has given technology platforms near complete immunity from the rampant sexual abuses they facilitate and even profit from.  

Reform of CDA Section 230 is necessary for a safer internet community, and would reflect the modern challenges that plague the Internet and its users. Ask Congress to fix the law to be what they always intended with the creation of CDA – a bill to protect kids online!

I am a constituent in your state, and I am writing to make sure you are aware that the Senate PASSED the Take it Down Act (S.146/H.R. 633) with UNANIMOUS Support! This bill provides vital relief to survivors of Image Based Sexual Abuse by requiring platforms to Take it Down. This is one of the most comprehensive bills in congress today to combat Image Based Sexual Abuse.

Image-based sexual abuse is when sexual images are created and/or distributed without the depicted individual's consent. Currently, there are NO federal laws protecting against image-based sexual abuse (IBSA). This is a terrifying hole in our country’s legislation which must be urgently resolved.

Advancements in artificial intelligence have made it terrifyingly easy for people to become victims of image-based sexual abuse, since realistic AI-generated or "deepfake" pornography can be created in a matter of seconds. All it takes is a photo of someone's face and a few clicks—it can happen to anyone.

The Take it Down Act has three primary goals:

  • criminalizes publishing or threatening to publish IBSA and AI-generated explicit imagery
  • requires platforms to remove the imagery and any similar imagery within 48 hours of the victim or the victim’s representative reporting it.
  • criminalizes the individual who published, or threatened to publish, the imagery, as well as platforms 
    Take it Down empowers victims to stop their abuse from repeatedly circulating online, without any hope of relief.

    Take it Down has widespread national support, with over 100 national, state, and local organizations in support. The time is now: Congress must pass the Take it Down Act to protect victims of IBSA. There are no more excuses. 

    Please cosponsor this important bill and encourage Chairman Guthrie to markup the Take it Down Act in the House Energy & Commerce Committee.
